This page identifies the company that operates Totalum and gives the information that Article 10 of Spanish Law 34/2002 (LSSI), Articles 11 to 13 of Regulation (EU) 2022/2065 (Digital Services Act), 17 U.S.C. § 512(c)(2), Spanish Law 7/2017 on alternative dispute resolution, California Civil Code § 1789.3 and comparable laws require us to make permanently, easily and directly accessible, free of charge.

2. Representatives and data protection contact

You can address requests, questions and complaints about personal data directly to Totalum, Inc. at contacto@totalum.app or by post to c/o Legalinc Corporate Services Inc., 131 Continental Drive, Suite 305, Newark, DE 19713, New Castle County, United States. We answer supervisory authorities in the European Union, the United Kingdom and elsewhere directly and cooperate with their enquiries. The Spanish Data Protection Agency (AEPD) is the authority we treat as our principal point of contact in the EU given where our infrastructure and most of our European customers are.

3. Points of contact under the Digital Services Act

Totalum, Inc. hosts websites and applications published by its customers and is therefore a provider of hosting services within the meaning of Regulation (EU) 2022/2065. Communications may be in English or Spanish.

  • Single point of contact for Member State authorities, the European Commission and the European Board for Digital Services (Article 11): contacto@totalum.app, subject line “DSA authority request”, and by post to c/o Legalinc Corporate Services Inc., 131 Continental Drive, Suite 305, Newark, DE 19713, New Castle County, United States. Requests must identify the issuing authority and its legal basis.
  • Single point of contact for recipients of the service (Article 12): contacto@totalum.app. Messages are read and answered by a person, not solely by automated tools. Recipients may also use the in-platform support chat.
  • Legal representative (Article 13): Totalum, Inc. itself, at the addresses above, until a representative established in the European Union is designated and published here.

Our terms and conditions on restrictions of use, content moderation, statements of reasons and appeals are in Section 9 of the Terms of Service and in the Acceptable Use Policy.

5. Reporting illegal content

Anyone may report content hosted on the Service that they believe is illegal or infringes our rules by emailing contacto@totalum.app with the exact URL, an explanation of why the content is illegal or infringing, the reporter's name and email, and a statement that the reporter believes in good faith that the information is accurate and complete. We confirm receipt, review reports in a timely, diligent, non-arbitrary and objective manner, inform the reporter of our decision and, where we act, give the affected user a statement of reasons and a way to appeal. Details are in Section 9 of the Terms of Service and Section 8 of the Acceptable Use Policy.

6. Complaints and dispute resolution

6.1 Complaint channel

You can complain free of charge at contacto@totalum.app or through the support chat in the platform. We acknowledge complaints promptly and answer them within one month at the latest. No premium-rate number is used for customer service.

6.2 Alternative dispute resolution (Spain and the European Union)

In accordance with Article 40 of Spanish Law 7/2017, we inform you that Totalum, Inc. is not adhered to any accredited alternative dispute resolution entity and has not undertaken to use one. If a complaint is not resolved to your satisfaction, consumers resident in Spain may apply to the Juntas Arbitrales de Consumo or the consumer authorities of their Autonomous Community; consumers resident in other EU Member States may apply to the accredited ADR entities of their country of residence. The European Commission's online dispute resolution (ODR) platform was discontinued on 20 July 2025 and is no longer available.

6.3 Courts

Consumers resident in the European Union, the United Kingdom, Switzerland and Latin America may bring proceedings in the courts of their place of residence, and we may bring proceedings against them only there, as stated in Section 22 of the Terms of Service. The arbitration agreement in Section 19 of the Terms applies to users in the United States and to business users where enforceable.

6.4 California residents

Under California Civil Code § 1789.3, California residents are entitled to the following consumer-rights notice: the Service is provided by Totalum, Inc., c/o Legalinc Corporate Services Inc., 131 Continental Drive, Suite 305, Newark, DE 19713, New Castle County, United States. Current prices are described in the Terms and on the pricing page. Complaints may be sent to contacto@totalum.app. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 (dca.ca.gov).

7. Prices and taxes

Prices are shown in euros to customers billed in Europe and in US dollars elsewhere, and are fixed by the billing country at the first purchase. For consumers in the European Union and the United Kingdom the price shown at checkout includes VAT at the rate of the consumer's country. For business customers prices are shown before tax; where a valid VAT or tax number is provided, the reverse-charge mechanism applies and the invoice says so. Elsewhere, sales tax, GST or similar taxes are added at checkout where we are required to collect them. There are no delivery costs. The full description of plans, credits, renewal, cancellation and price changes is in Section 5 of the Terms of Service.

8. Contract formation and archiving

In accordance with Articles 27 and 28 of Law 34/2002 (LSSI) and Article 8 of Directive 2011/83/EU, the contract is concluded as follows: (1) you create an account by accepting the Terms of Service and the Privacy Policy; (2) you select a plan or credit pack and review the summary showing the price, taxes, billing period and renewal terms; (3) you can correct any input error on the checkout page before confirming; (4) you confirm by clicking the button labelled with the obligation to pay; (5) we send a confirmation email within 24 hours containing the terms of the order and the cancellation policy. The contract is archived and remains accessible to you in the Billing settings of your account, together with your invoices. The contract can be concluded in English or in Spanish; the version applicable to consumers is the one in which they contracted.

9. Codes of conduct

Totalum, Inc. is not currently adhered to any code of conduct within the meaning of Article 10.1(g) of the LSSI or Article 40 of the GDPR. We follow the usage policies of our AI model providers, referenced in the Acceptable Use Policy.

10. Intellectual property

Totalum and the Totalum logo are trademarks of Totalum, Inc.. The websites, the platform, the documentation, the templates, the SDKs and all other Totalum Materials are protected by copyright and other intellectual-property laws and may not be reproduced, distributed or used except as permitted by the Terms of Service. Third-party names and logos on our websites belong to their owners and are used for identification only. Applications built by customers with the Service belong to those customers.

11. Do Not Track and Global Privacy Control

In accordance with the Delaware Online Privacy and Protection Act and comparable laws: our websites honour the Global Privacy Control signal as an opt-out from the sale or sharing of personal information and from targeted advertising, on the browser that sends it. We do not respond to the older “Do Not Track” browser setting, which has no agreed meaning. Third parties may collect information about your online activities over time and across different websites when you visit our marketing site only if you allow marketing cookies; see the Your Privacy Choices section of the Privacy Policy and the Cookie Policy.

12. Accessibility

We aim for the marketing website and the platform to conform to WCAG 2.1 level AA. Known gaps as of the effective date: some interactive 3D and animated sections of the marketing site have no reduced-motion equivalent, some third-party embedded content is outside our control, and the visual editor and the code panel of the workspace are not yet fully operable by keyboard alone. If you encounter a barrier, need content in an alternative format or want to report an accessibility problem, write to contacto@totalum.app and we will respond within a reasonable time. Applications built by customers are the responsibility of those customers.

13. Security vulnerability disclosure

If you believe you have found a security vulnerability in Totalum's websites, platform, API or infrastructure, report it to contacto@totalum.app with enough detail to reproduce it. We acknowledge reports promptly, keep you informed of the fix and credit you if you wish. We will not pursue legal action, or refer to law enforcement, security research conducted in good faith in accordance with this policy: act only on your own accounts and test data, never access, modify or exfiltrate other customers' data, do not perform denial-of-service, spam, social engineering or physical attacks, stop and report as soon as you confirm a vulnerability, and give us a reasonable time to fix it before any public disclosure. Testing against applications published by our customers requires the permission of that customer.
